Learning outcomes of course unit

Upon successful completion of the course, students are able to represent and to explain the practical judicial procedure of insolvency and its respective impact on the debtor.

Two large blocks of topics
a) Proceedings before the opening of insolvency proceedings
b) Judicial insolvency proceedings

After the presentation of the theoretical foundations, special focus is on the handling of anonymized practical cases. Examples: interpretation of the concept of insolvency on the basis of an execution register; preferential claims on the basis of proceedings lacking assets, final distribution to creditors on the basis of a distribution draft; reorganization proceedings with / without self-administration based on two reorganization proposals with votes in the meeting of creditors, etc. Thus, the students gain a deeper insight in part of the "legal principles”.
